Terms and Conditions for Copywriters
Following are the terms and conditions for Copywriters, other Writers, and translators. In this document the term 'Copywriters' or 'you' refers to all these categories of people. The people that source Copywriters are referred to as 'Clients'. Wordfruit is referred to as 'Wordfruit' and 'we'/'us'.
These Terms and conditions are effective as of November 25, 2012. They may be updated without notice, and updates will be effective immediately. Please check back from time to time. There is a link to the current Terms and Conditions in the menu-footer of the Homepage at Wordfruit.com
Use of the Wordfruit services and website indicates that you accept the current Terms and Conditions.
Membership acceptance
Copywriter membership of Wordfruit is not open to all. Membership is only open to Copywriters with excellent portfolios. Membership is granted based on the information and the work samples that you give in the application process. Wordfruit staff members are the only people that make the decisions on Wordfruit membership approval.
The data you provide
You agree to provide true and accurate information in your application and in all communications with Wordfruit and you agree to provide the entirety of relevant information. In your application we ask to see your best work; not all your work. Please maintain a very high standard of work for all Clients that you connect with through Wordfruit.
The recruitment process
You agree to the following items:
Wordfruit enables Clients to connect with you through 2 methods:

Method 1:
This involves Wordfruit Admin matching jobs to Copywriters' profile info. Details follow:
With this method, we connect Clients to shortlists of Writers, according to the Client's request and the nature of the job.
We send job descriptions to you that we believe fit your profile details. For jobs that you are interested in and have the time available, please tell us as soon as possible. When we send you a job description, we cannot keep the opening for long, because we need to get back to the Client quickly. So we'll offer the connection to another Copywriter if we do not receive a response from you. The time we can wait varies depending on the requirements of the job.
Once you've told us you are available for a job, and with the connection remaining open to you, we send your contact details to the Client and we send the contact details of the Client to you.
Please notify us that you are available for jobs that you are interested in and that you can handle with your skills and your time available. If you don't have the time to schedule a particular job, or if you are not interested in the job, please notify us of this.
Method 2:
This method applies when Clients request a longer list of Writers, from which they themselves compile a shortlist.
We send job descriptions out to Writers who are a match for the job.
If you are interested in the job and you can handle the job with your skills and time available, please contact the Client direct.
If you are not available for the job, there is no obligation to notify the Client or Wordfruit staff.
We send these job leads out to you based on your portfolio work and other info, but we need to do the matching more quickly for these jobs, so you might receive some job leads that are not a 100% match for you.
Wordfruit fees
Writers do not pay any fees to Wordfruit.
We send Writers jobs from industry professional clients -- marketing and advertising agencies, as well as direct clients.
Membership at management discretion
Continued membership of Wordfruit is at the sole discretion of Wordfruit management.
Not involved in Copywriter-Client contracts
Wordfruit is for Copywriters to find jobs and Clients. Wordfruit is not involved in negotiating contract terms between Copywriters and Clients.
Schedules of payments and terms relating to payment for your work, are based on your agreements with your Clients.
Wordfruit recommends that you use written contracts. If you prefer an up-front payment schedule, then use an up-front payment schedule. If you wish, you can outline your terms in your Wordfruit profile.
You are responsible for collecting payments from Clients that you connect with through Wordfruit. Wordfruit is not responsible for collecting your payments. Wordfruit is not responsible for paying you.
Communication between Copywriters and Clients is not through the Wordfruit site itself: it is through email, phone, etc.
Positive dealings
You agree not to tamper with or disrupt the workings of the Wordfruit website or services in any way. You agree to endeavor to maintain good relations with Clients that you connect with through Wordfruit. You agree not to gather members' information and not to send spam to any Wordfruit members.
Client communication
Please be well meaning and professional in all Client communication, and efficient in replies. Please ask the questions you need to in order to ensure you fully understand the needs of Clients, so that you can produce your best work for the job. Please bear in mind the knowledge and experience of the Client you're dealing with: some have lots of experience in industries related to copywriting; others don't. Some Wordfruit Clients' first languages are not English: please communicate appropriately. Please be honest in your dealings with Clients. And if you're wrong about something, please admit it.
Your personal details
Personal data that you provide to Wordfruit is security protected. However, we cannot guarantee that unauthorized third parties will not access this data. You post details at your own risk.

No guarantee or warranty
With the Wordfruit system, we aim to provide Copywriters with connections to industry professionals in marketing and advertising, and related industries, as well as direct to Clients who are professional in their approach. However, we offer no guarantee of this.
Wordfruit does not give any guarantee or warranty in relation to any matter relating to membership or service provision, and we accept no liability in relation thereto.
No liability
To the extent permitted by law, in no event will Wordfruit be liable to you for any damages in relation to any matter, howsoever incurred.
Disputes
Wordfruit aims to provide a quality service that is right for the market. If any cause for potential dispute with Wordfruit arises, you agree to contact Wordfruit in the first instance, and to make adequate efforts to resolve the potential dispute in direct communication with Richard Clunan of Wordfruit.
Wordfruit is based in the Republic of Ireland, and this agreement is subject to the laws of the Republic of Ireland. You agree that any dispute with Wordfruit must be resolved in court(s) located in the Republic of Ireland. You hereby submit to the jurisdiction of the courts located in the Republic of Ireland and to these courts exclusively.
